Terms and Conditions of Use

1. Service Provider Identification

In accordance with Law 34/2002 of July 11 on Information Society Services and Electronic Commerce (LSSI), the following details of the service provider are stated:

2. Acceptance of the Terms

Access to and use of The fAIfth Trader™ implies full and unconditional acceptance of these Terms and Conditions. If you do not agree, you must not use the service.

3. Description of the Service

The fAIfth Trader™ is an artificial-intelligence-based trading analysis and trade management platform integrated with MetaTrader (MT4/MT5). The service includes:

  • AI-powered market analysis
  • Automated trading strategy management
  • Order execution through EA (Expert Advisors)
  • Dashboard and monitoring panel

4. IMPORTANT NOTICE — Financial Risk

Trading financial instruments involves a substantial risk of loss.

  • The fAIfth Trader™ is NOT financial advice. The platform is an analysis and automation tool.
  • Investment decisions are the sole responsibility of the user.
  • Past performance does not guarantee future results.
  • You should only trade with capital you can afford to lose.
  • AI may make mistakes. Generated signals are indicative only and do not constitute investment recommendations.
  • Safe Capital Traders™ is not responsible for losses arising from use of the platform.

5. User Accounts

5.1 Registration

To use the service you must register by providing truthful information. You must be of legal age (18+).

5.2 Email Verification

Email verification is required to activate the account.

5.3 Security

You are responsible for maintaining the confidentiality of your credentials (password, EA tokens, API keys). Safe Capital Traders™ is not responsible for unauthorized access caused by user negligence.

5.4 Plans and Billing

  • Plans are billed monthly via Stripe.
  • You may cancel at any time; cancellation takes effect at the end of the billing period.
  • No refunds are issued for periods already billed.
  • Plan upgrades take effect immediately; downgrades take effect at the end of the period.

6. Early Access

  • The service may be provided free of charge or under preferred conditions during a pre-launch early access phase, initially estimated at 30 days, which may be extended, shortened, modified, or ended by Safe Capital Traders™.
  • The user accepts that, during this phase, the service may contain errors, limitations, functional changes, or interruptions while the product is being validated and refined.
  • Early access participants may be asked to provide feedback, operating observations, or validation about their experience.
  • Safe Capital Traders™ may limit, suspend, or end early access at any time, and may individually decide continuity, extension, or transition into final plans.

7. Data Protection

The processing of personal data is governed by our Privacy Policy, prepared in compliance with the GDPR (EU Regulation 2016/679) and the Spanish Organic Law 3/2018.

8. Intellectual Property

  • The fAIfth Trader™, its code, design, logos, and content are the property of David Barrero Martínez / Safe Capital Traders™.
  • The Expert Advisors (EA) are proprietary software. Their distribution, copying, or reverse engineering is prohibited.
  • The user retains ownership of their strategies and trading data.

9. Prohibited Uses

The user agrees NOT to:

  • Share their account with third parties
  • Attempt to access, modify, or interfere with Safe Capital Traders™ systems
  • Reverse engineer the software
  • Use the service for unlawful activities
  • Mass extract data (scraping) from the platform

10. Limitation of Liability

Safe Capital Traders™ shall not be liable for:

  • Financial losses arising from the use of the platform
  • Service interruptions due to technical causes or force majeure
  • Indirect, incidental, or consequential damages
  • The availability of brokers or MetaTrader
  • AI decisions resulting in losses

11. Modifications

Safe Capital Traders™ reserves the right to modify these terms at any time. Changes will be notified by email to registered users at least 15 days in advance.

12. Account Suspension

Safe Capital Traders™ may suspend or cancel accounts that:

  • Violate these terms
  • Carry out fraudulent or abusive activities
  • Generate abnormal use of the service

13. Applicable Law and Jurisdiction

These terms are governed by Spanish law. For the resolution of disputes, the parties submit to the courts of Palma de Mallorca, Balearic Islands, Spain.
